It's becoming increasingly clear that a major, ugly battle in Bush and Co.'s ongoing war against the U.S. Constitution was waged right here in the Philly area yesterday. As the usually on-target Dana Milbank of the Washington Post recounts, Secret Service agents at the president's rally in suburban Colmar were used for the purpose of blocking reporters' access to anti-Bush protestors -- a clear and blatant violation of the First Amendment.
There clearly were no security issues. Reporters who didn't try to interview the AIDS protestors from Philly's chapter of ACT UP were allowed to come and go as they pleased. And, as the article notes: "Officially, the Secret Service does not concern itself with unarmed, peaceful demonstrators who pose no danger to the commander in chief. But that policy was inoperative here."
Here's the most important passage from Milbank's account:
"One uniformed Secret Service agent complained to a colleague that 'the press is having a field day' with the disruption -- and the agents quickly clamped down. Journalists were told that if they sought to approach the demonstrators, they would not be allowed to return to the event site -- even though their colleagues were free to come and go."
"An agent, who did not give his name, told one journalist who was blocked from returning to the speech that this was punishment for approaching the demonstrators and that there was a 'different set of rules' for reporters who did not seek out the activists."
In keeping with the fair and dangerously unbalanced tone of Campaign Extra!, we're outraged. Is anyone else? America is supposed to have just one set of rules -- in this case, free speech.
We'd REALLY like to hear from anyone who was there on either side -- either from ACT UP or from the 1,500 or so pro-Bush Philly suburbanites. Let us know your version of what happened, and we'll post it on Campaign Extra! as soon as we get it.
UPDATE: Campaign Extra! spoke today with James Borasi, the Secret Service agent-in-charge for Philadelphia, who was at the Bush event yesterday. He insisted that nothing out of the ordinary happened -- that the protestors had been removed to a secure area for questioning. He insisted that as a matter of standard procedure any journalist who went to talk to them would have left the "access zone" and would not be allowed re-entry.
He called the interview where the protestor/hecklers were taken a "law enforcement zone" off limits to reporters. However, Borasi was unable to explain the agent's alleged comment about a 'different set of rules' for reporters who did not seek out the activists."
ugh. business as usual in shrubs world.
just like "free speech zones", a blatant chimpish smirk at the constitution.

As usual the press is focusing on the 2 or 3 protesters and not the 1500 or so supporters. Were these people to act that way in your news building you would be the first ones calling security and having them escorted from your building. The simple fact is that they are disruptive and rude. Freedom of speech is one of our cherished rights but it seems that the protesters forget that with each right comes a responsibility. There are plenty of other means for people to voice their opinion. Your newspaper encourages this type of behavior by focusing more attention on the protesters than the simple fact that most times they are breaking the law. call them lawbreakers instead of "protesters".

thank you ruth but the heart of the issue is the press over emphasis on interviewing and glorifying the people who infringed on the rights of everyone else there and were rightfully ejected. if the press truly felt outraged they, i am sure, will file another lawsuit tying up our court system and adding to taxpayer expense.

Because a journalist interviews a protestor, it does not follow that there will be a "glorification" of the protestor. The purpose of the First Amendment is to maintain a free exchange of ideas, so that citizens can make informed, democratic decisions. The Bush administration has shown its hostility to free exchange of ideas at every opportunity. I take this as a symptom of their hostility to democracy.
Soon I expect that journalists covering Bush rallies will also have to sign "loyalty oaths."

They had no intention of disrupting the event. They only wanted to hear what their President had to say, and they were prevented from doing so at Bush's whim. You're right First Paradox, next the Secret Service and Bush's aides are going to prevent the press from talking to anyone at Bush/Cheney events unless they sign "loyalty oaths." The issue is free speech and the Constitution.

Two undecided Republicans who wanted to hear what the president had to say, so they could be reassured, went away decided right then and there.
(It was just one of those poetic justice things that there was a massive typo in the middle of the loyalty oath.)
This was right about the time that they were asking for the ethnicity of journalists, and came up with lame excuses when the newspaper refused and publicized it.

Imagine you were at a rally and couldn't help but yell out "bullshit" at some particularly egerigious lie. Security swoops down and removes you (which is understandable), and takes you away. A journalist at the event is wondering what pissed you off so much, so they head over to ask you, but security informs them that if they talk to you, they won't be allowed to cover the rally (which is the primary story the reporter is working on).
This is clearly obstruction of a free-press.

What amazed me even more than the lies coming out of our dear commander's mouth, was how conspicuous we (from ACT UP) were for being young and multi-racial. Some of us may have appeared nervous (I certainly was), but I think people couldn't believe there were people of color there who were not on stage as tokens- especialy more than one. Compassion (even with the queer-bashing left out) isn't colorblind apparently.

I have covered many public events in my career, and some have had protests at them.
I have never been prevented from talking to a person who had been removed from an event. In fact, I have conducted many an interview with people who were in handcuffs, having committed civil disobedience. At no time did a member of the law enforcement community attempt to stop me.
And, when the interview was complete, I was allowed in all cases to return to the main event.
This is out of bounds, but par for the course for a President who cannot be allowed to see that others disagree with him.
A guy who didn't win a majority last time and doesn't have a majority now does NOT need to piss off the national press. It is a huge political risk, as well as stupid.
(Incidentally, spare me the liberal-press claptrap. I'm a lifelong registered independent, and I haven't decided who to vote for yet, but the one that's the most truly conservative will get my vote. And that includes a conservative -- in the meaning of the root word "conserve" -- approach to civil rights, as well as money.)

The Republican Party has long demonstrated a certain nervous nature concerning those individuals who do not agree with their own ideas. It's evident by their aggressive, misleading arguments. Bush is only using his resources in any manner that is beneficial to himself. That is what he has done since he came into office and it is what he will do for the next four years if re-elected.
The abuse of the constitution is unsettling, obviously. What worries me more is what other instances of power abuse have occured without our knowing it, or being lead to believe something different was actually happening.

I know people who attended the RNC and have attended several Bush rally's including the one we are discussing. They were never asked to sign an oath of support.
The hair pulling incident never should have happened. There are ways to remove someone peaceably and there are ways to protest peacebly. I'm not sure that either side was acting in a peaceful manner in this instance.
As for demonstrators being interviewed by the press....it is their right as protected by the First Amendment to tell their story...it is also my right as protected by the First Admendment to be able to hear it or not as I so choose. The fact that the members of the press were not allowed to return to the rally can be viewed as a matter of security not as a matter of censorship. As stated by James Borasi, "as a matter of standard procedure any journalist who went to talk to them would have left the "access zone" and would not be allowed re-entry." People should not be allowed to come and go as they please when attending these political rally's no matter which side it's for.
Senator Kerry should also be exercising the same priviledge to kick disruptive people from his rally's. If we can't hear the candidate's ideas because of people who want to have their voice heard no matter the cost, how can we make an informed decision.
Agree with the President or disagree with him...he's still the Commander in Chief and we must protect him from those who intend to do him harm.

Trespass charges dropped against Bush protesters

CHARLESTON, W.Va. -- Trespassing charges against two people who wore anti-Bush T-shirts to the president’s July 4 rally at the West Virginia Capitol were dropped Thursday because a city ordinance did not cover trespassing on Statehouse grounds.
Nicole and Jeff Rank of Corpus Christi, Texas, were removed from the event in restraints after taking off an outer layer of clothes to reveal homemade T-shirts that had President Bush’s name with a slash through it and the words "Love America, Hate Bush" on the back.
The Ranks were given summonses to appear in Charleston Municipal Court and released.
Charleston Municipal Judge Carole Bloom dismissed the charges on the motion of Assistant City Attorney Deloris Martin.
Nicole Rank, 30, who was doing environmental work for the Federal Emergency Management Agency in the wake of Memorial Day flooding in the state, was released from her position after her arrest without getting another assignment. She remains employed with FEMA.
Jeff Rank, 28, who is an unemployed oceanographer, was in West Virginia to be with her.
She said Thursday it is not uncommon to leave one FEMA job before being assigned another, although she had expected to work in West Virginia longer.
The couple said they were pleased with the case’s outcome and planned to return to Texas immediately.
Jeff Rank said the couple did not go the Capitol with the intention of being arrested. They are supporters of presumptive Democratic nominee John Kerry, but wanted to take advantage of an opportunity to see Bush and "give him a fair hearing."
"We certainly did not expect to be arrested for expressing our freedom of expression," Jeff Rank said.
He said they were not protesting in any other way than simply wearing the shirts and did not said anything.
Law enforcement officers told the couple to take the shirts off, cover them or get out. When they refused and sat down, they were arrested. They then stood and accompanied the police, said Charleston Mayor Danny Jones.
The Ranks said they have not protested at other political events and do not have any immediate plans to do so again.
"We’ll continue to exercise our right to free expression when we see fit. We’re not professional protesters," Jeff Rank said. "We’re going to get on with our lives and go back to Texas and get jobs."
Jones said, "I don’t think this was just about a T-shirt issue. There were other things going on there. The officers, quite frankly, feared for the safety of the Ranks."
Jones said the city officers who filed the trespassing charges were acting under the direction of the Secret Service.
"The officers are in a bind here," Jones said.
"I think we need some guidance. Perhaps the Secret Service should have been called and let the Secret Service do with them what they want," Jones said.
"The city of Charleston does not engage in violating people’s rights. We want everybody to come here," said Jones, a Republican.
Still, he said he would not apologize to the Ranks.
"They were there to get arrested. They succeeded."
Jones said he would talk to police before Kerry’s appearance Thursday evening at the University of Charleston. The Massachusetts senator was scheduled to appear at a rally on a lawn across the Kanawha River from the Capitol.
The Ranks were accompanied to the hearing by an attorney affiliated with the American Civil Liberties Union.
Andrew Schneider, executive director of the ACLU’s West Virginia chapter, said the organization has been monitoring a pattern of similar cases in other states. The ACLU in September filed a federal lawsuit against the Secret Service, seeking an injunction against the Bush administration for segregating protesters at his public appearances.
The Secret Service agreed to stop the practice, ACLU attorney Witold Walczak told The Charleston Gazette.
Schneider said, "This case demonstrates we will be out there watching and monitoring to make sure free speech rights are not violated regardless of political affiliation."

Violence is the last refuge of the incompetent. I wish you all would stop blaming and blaming and blaming the deaths of 1000 soldiers on Bush. That is like trying to say Henry Ford is pretty much responisble for all car deaths since the first car was invented, which is completely absurd. I make the decision, just as you do I imagine, to risk my life every day I get in my car, just as these soldiers knew they might, by joining the military. The point is these men and women felt a greater civic duty than your whining, finger pointing self ever will, and stepped up to the plate knowing they might have the chance to serve their country in a way that few men and women ever will. If you want to keep saying Bush caused the death of all these people I want you to show me where Bush made them sign up for military service, I want you to show me one instance in which a serviceman says he was duped into military service and then got sent to war. Even then, I still won't take the crap that Bush caused the deaths of all these men. Get past your liberal brain clot and realize that "insurgents", and people with the same goal you have, caused the deaths of these men and women, and if you don't see the relation yet, I say you helped cause the death of these men and women by fighting along side these "insurgents".

The First Amendment guarantees several things, including the freedom of speech, freedom of expression, and the freedom of the press.
These points are important in this debate for several reasons:
1. Whether you are pro-Bush or pro-Kerry or just don't give a darn, what protestors do, don't do, say, or don't say is completely irrelevant to this entire debate. The freedom of speech is not about agreeing with someone's words or tactics--it's purely about being able to say what's on your mind without fear of government reprisals.
2. The First Amendment protects against governmental acts that impede upon the rights of all citizens of the United States. However, it does not prevent private entities from supressing speech or expression. This is why it's legal and constitutional to eject drunken, obnoxious slobs from an Eagles concert (a private event) but it's illegal and unconstitutional to squelch dissent and press access at a Presidential campaign rally (a public event).
3. Barring reporters from talking to protestors is the clearest example of a violation of freedom of the press. Even the most naive 1st year law student would be able to see this.
4. The First Amendment does not protect citizens' right to hear someone speak from another citizen causing a "disruption." Remember, the First Amendment only protects against government action; protestors are not government actors--the First Amendment DOES NOT offer protection from their comments or even their airhorns.
5. Let's all take a deep breath and remember what country we all live in. This is the United States of America, folks. This nation was founded on dissent, disagreement, and debate. Supressing any of these things is fundamentally against the spirit of our nation. Let freedom ring.

It also states that the commander in chief will never send them into harms way unless millitary action is warranted. This oath (which I have taken, and under which I currently serve), says *nothing* about subjectively deciding when military action is warranted. I (like many of my brethren) have mixed opinions about our Commander in Chief, but I joined the Army expressly *because* of the fact that we were going back to Iraq to finish a job we started over a decade ago. I hear countless arguments about "where are all the WMDs? Bush must have made it all up!" which is frankly a bunch of B.S. Now, when the U.N. issues close to two dozen resolutions regarding disarmament and inspections which were given lip service at best, and does *NOTHING* to enforce its own rules, then it's ultimately up to someone like the U.S. President to say "enough is enough."

The issue is whether he had any WMD after 1998 - the inspectors from the IAEA and UNSCOM said there was nothing there. If Saddam did have chemical weapons remaining that he kept hidden, they would be utterly useless - their contents expire and he never had the means to develop systems which could preserve them. Twelve year old anthrax is as toxic as a Diet Coke.
Read the reports, kid. Think for yourself. There was nothing there. And if something is found, it will be too late. No one will believe we didn't plant the weapons, because no one trusts us anymore.

Bush and Cheney repeatedly said they knew precisely where specific stockpiles (e.g. 100 miles north of Basra) of specific amounts (500 tons) of specific weapons (VX, sarin etc...) were specifically stored. But after we invaded, the explanations of why we couldn't find anything aren't quite as specific anymore. Maybe he buried them in the desert. Maybe he shipped them to Syria. The evidence supporting such hypotheses is hardly compelling.
