The Burning, Bush

Here's a riddle for the eve of the second Bush administration. When does a fire suddenly become a federal crime?

Answer: When the victim is a huge campaign donor to the head of the federal government, i.e., George W. Bush.

Today, federal prosecutors indicted five men in the highly publicized case in Maryland where 26 homes under construction in a new subdivision were burned to the ground or damaged. The men were charged with arson, conspiracy to commit arson and aiding and abetting arson. Because the federal arson and conspiracy charges carry mandatory minimum penalties of 5 to 20 years, the culprits -- apparently an odd mix of disgruntled-employee types and gang wannabes -- could face some serious prison time.

The suspects are all from around the Greenbelt, Md., area, where the arson took place. No one was hurt or killed. So what makes this a federal crime? According to tomorrow's New York Times: "The fire was considered a federal crime because it interfered with the interstate activities of the subdivision's developer, the Lennar Corporation of Miami, and its business partners, officials said."

Just who is the Lennar Corp.

According to federal campaign records, Lennar's CEO, Stuart Miller, is a big backer of the GOP. He donated $25,000 to the Republican National Committee on April 21, 2004, and on June 17 of last year, he have $61,500 to two national GOP committees -- the 2004 Joint Candidate Committee and the 2004 Joint State Victory Committees.

In 2003, Lennar was embroiled in a controversy over whether a plan aggressively pursued by Florida Gov. Jeb Bush -- to spend state money to attract a biotechnolgy research center -- would have benefitted Lennar, which was all set to build homes right next door.

We're no lawyers, and we're not experts on when a crime that's mostly prosecuted on the state level -- such as arson -- becomes a federal case. But given the people involved, we'd love to see some real legal experts check out this one.

Good to see the blcg back!

I was moved to google "Federal arson law" and found my second hit, http://www.law.com/jsp/article.jsp?id=1087242921803,
a real goldmine of information. Apparently Federal courts decided several years ago that burning private homes is not a Federal crime. Interestingly, the justices who support state law prevailing over Federal tend to be conservative, including recent Bush appointments.
